5 Small Claims Court Case Mistakes and How to Avoid Them

It’s safe to say that no one likes to have disagreements with others. Having disagreements over money is even worse. The good news is that there are ways that you can settle a claim over money.

You might have a small claims court case on your hands. You have to be prepared to win your case. Don’t go to court without having a plan in place.

Here are five common small claims court case mistakes you shouldn’t make. Read on to learn more about them and how to avoid them.

1. Not Considering Your Options

So, you have a disagreement with a business over money? Your first thought might be that you need to go to small claims court. Filing a claim might not be the first thing you need to do.

Check what other options you might have to get your compensation. You might be able to settle with the help of a mediator. This can all take place behind closed doors without having to involve the court system.

2. Not Organizing Your Case

You might think that your small claims case is clear, so there’s a winning case. So you think you can show up to court without preparation? Well, not so fast!

Organize your case before you show up to court. Collect all the evidence you need to present to the court. This includes copies of receipts and contracts.

3. Failing to Hire a Lawyer

Choosing a lawyer for your small claims court case is a good idea. Talking to your lawyer before your court date can help you learn about all your legal options.

Having a lawyer on your side can make the entire process go smoother. Your lawyer can help you win your case without you having to stress so much.

4. Underestimating Your Opponent

One of the biggest mistakes you can make is underestimating your opponent. Don’t have this attitude going into your court date as it can reduce your chances of winning.

Let’s say you’re going to sue a towing company. You might think that the owner of the company is sleazy and educated. Don’t assume that this is the case as that person might have a good lawyer representing them.

5. Not Documenting Expenses

Don’t go to small claims court to collect money just because you believe it’s owed to you. You need to document small claims court expenses. Take the time to do this even if you believe you have a clear case.

Take all your receipts that help show your financial losses. Do keep in mind that the judge will have the final say in the judgment.

Don’t Commit These Five Small Claims Court Case Mistakes

Have an upcoming small claims court case? If you do, you must not commit these five mistakes. Avoid them at all costs to help you win your case.
